Recent court decisions raise questions about when a bidder on a construction contract with a Pennsylvania state agency can file a bid protest.
Prospective bidders who wish to challenge the state’s award of a bid must do so through certain procedures set forth in the law. A protest must be filed: 1) within 7 days of when the bidder knew of the facts giving rise to his protest, and; 2) no later than 7 days after the contract is awarded.
