The Pennsylvania Liquor Control Board issued an “advisory opinion” on Friday, March 6, 2015, stating that distributors are permitted to sell brewed beverages by the 12-pack. Prior to this opinion, it was generally understood that distributors were only allowed to sell beer by the case or keg.
The LCB has now made it clear that distributors can sell 12-packs to customers so long as (1) the 12-pack contains no less than 128 ounces in total, and (2) the original manufacturer originally packaged the brew and intended the brew to be sold as 12-packs. Thus, the distributor is not permitted to buy the manufacturer’s product then separate or modify it into 12-packs (i.e. break down cases into sets of 12).
It has been reported that this clarification in the law will allow customers to purchase cheaper 12-packs of specialty beers rather than more expensive cases.
