Clients often ask what it takes for a mediation to be successful, i.e., result in a final resolution of the dispute between the parties. Based on my experience there are 5 steps which are essential to a successful mediation. Those 5 steps are: (1) pick the right time to mediate, (2) select the correct mediator, (3) set aside adequate time for the mediation, (4) be certain all parties to the mediation have full settlement authority and (5) make sure all parties are amenable to compromise. Each of these steps require consideration of a number of different issues which I have addressed in separate blogs on each of these steps.
